PLEASE NOTE THAT ON BUSY TURNOVER DAYS WE MAKE EVERY EFFORT TO HAVE YOUR PROPERTY READY FOR 4:00 PM CHECK IN. NO REFUNDS CAN BE GIVEN FOR UNITS THAT ARE NOT QUITE READY BY 4:00 PM WE APPRECIATE YOUR COOPERATION AND PATIENCE ON THESE BUSY DAYS.

Rental Terms and Conditions
-RENTAL DOWN PAYMENT:

All reservations require a 25% rental down payment at the time of booking. These rental down payments are required to confirm your reservation but are applied toward your final payment. Each reservation requires a $150.00 nonrefundable processing fee.

*Final payments are due 60 days prior to arrival payable by personal check or Echeck (which will incur a $1.00 processing fee) we do take credit cards for final payment with a 3% fee on the balance due. Your contract serves as your final invoice- Final payments not received on time will be charged to the payment method on file with the fees mentioned above, your signed contract will serve as acknowledgement of these terms and authorizes us to initiate this transaction, and waives any rights to stop payment or initiate a chargeback. Any and all fees for processing payments or returned checks will be billed to the payment method on file. It is the guest’s responsibility to keep Island Vacation Properties updated with accurate current and active payment methods. *Please note that your reservation is not confirmed until your down payment is received, your E-Contract is digitally signed and on file. Your reservation is subject to cancellation without a digital signature on file and or unpaid down payments or balances due*

-CANCELLATION POLICY:

Within 60 days of arrival funds are nonrefundable. Cancellations made more than 60 days out from arrival will incur a cancellation fee of 50% of your initial down payment, plus any credit card fees incurred, we are unable to issue refunds due to inclement weather, acts of mother nature, red tide, broken appliances or other aspects beyond our control in surrounding areas or properties. We are not notified of construction in surrounding areas, Island Vacation Properties and or the property owner cannot be held liable for any construction near your rental property, or any inconveniences due to construction. No refunds will be given under these circumstances. Any refunds issued within 60 days of arrival are at the sole discretion of the property owner, in some cases Island Vacation Properties may reach out to an owner to get authorization for a refund.

We strongly advise to protect your vacation by purchasing Travelers Insurance, this is the best way to protect yourself.

-SWIMMING POOLS: Pools are regularly cleaned, treated and maintained at the owner’s expense. Following inclement weather or high winds, pool service cannot be expected “on demand” for removal of fallen leaves or minor debris. Pool skimmers are available for your use if you need them. Pools are heated from approximately Thanksgiving to Easter only and are set no higher than 82 degrees. During colder weather, we cannot guarantee that the pool can be maintained to that degree. No refunds will be offered if the pool temperature cannot be maintained due to unusually cold weather. Under no circumstances are guests to change any settings on the pool equipment. Any repair charges resulting from a guest tampering with the pool equipment will be the responsibility of the guest.

TAX: Rentals of less than six months are subject to Florida State Sales Tax of 7% and Manatee County Resort Tax of 5%.

OCCUPANCY: Each unit has a maximum capacity, which you were informed of when making your reservation. Overcrowding of units will result in the immediate eviction and loss of deposit and rent. Large gatherings are not permitted on the premises without prior written approval of the rental agent.

NOISE ORDINANCE: Anna Maria Island has a zero tolerance for noise after 10 PM. Please show consideration for your neighbors. No loud music, parties or playing in pools after 10 PM. If a neighbor complains the Police Department has no choice but to file a complaint. Any tickets issued for noise violations will be the responsibility of the guest and may result in immediate eviction with no refunds of rent or deposits.

AMENITIES: Each of our rentals is individually owned and reflects the tastes of the owners. We do our best to accurately describe each unit and its amenities prior to booking but cannot be held responsible if tenants are dissatisfied with the accommodations, or an owner changes furnishings, décor, etc. prior to your arrival. If you have any questions about the unit amenities, please call our office. We will gladly discuss them with you.

PETS: Units allowing pets require a $150.00 non-refundable pet fee per pet. Any unauthorized pets will result in a penalty equal to your initial rental down payment and will immediately be charged to your credit card and or immediate eviction. Unfortunately, most properties do not allow any pets over 25 pounds. Multiple pets and or larger pets are allowed in very few properties with a $150.00 non-refundable pet fee per pet, please discuss with our office if you have a larger or multiple pets. You are responsible for cleaning up after your pet including any pet waste and hair. We do not allow pets on furniture or beds/bedding. Additional fees may be immediately charged to credit card on file for any damage or additional cleaning, a 3 % credit card fee will be applied.

ITEMS LEFT IN UNIT: Neither the landlord nor Island Vacation Properties, LLC, will be held responsible for any personal items left in the units. If you request us to retrieve and mail items left in the unit, you will be responsible for mailing/shipping charges plus $25.00 processing fee.

INOPERABLE EQUIPMENT: Should any mechanical failures occur during your stay, Island Vacation Properties will do their best to make prompt and thorough repairs. Unfortunately, we cannot offer refunds for inconvenience caused by inoperable equipment, and you agree to hold harmless Island Vacation Properties or the owner of the property. If there is a problem and it is deemed guest negligence any repair costs will be billed to the card on file, a 3% credit card fee will be applied.

AIR CONDITIONING: Do not set air below 72 degrees, please be sure all doors and windows are closed when air conditioning is running. Damages due to improper use will be billed to the card on file, a 3% credit card fee will be applied.

PLUMBING/GARBAGE DISPOSAL: Do not put any items in toilets, except for toilet paper. When using garbage disposals please be sure water is running and do not put fruit, vegetable peelings in garbage disposals. Also do not put any bones, shrimp peels or anything of the like in the garbage disposal. Any repairs or service calls due to these items will be billed to the card on file, a 3% credit card fee will be applied.

INTERNET SERVICE: Our units offer free Wifi for your convenience. Due to the numerous different providers and age and configuration of your device, we cannot guarantee that you will be able to connect. We will do our best to assist you but cannot be held responsible and no refunds will be offered if you are unable to take advantage of this service.

**Any Pay Per Movies or cable/programming upgrades/changes made to the property will be billed to the card on file, a 3% credit card fee will be applied.**

UNIT SUPPLIES: There will be a starter supply of toilet paper, dish soap, dishwasher pods and some trash bags when you arrive but you will need to purchase paper and cleaning products (paper towels, hand soap, toilet paper, laundry detergent, etc.) as needed. Please remember that you are renting a vacation home, not a hotel. Beach towels and beach chairs are provided at owners’ discretion.

RIGHT OF FIRST REFUSAL: We do not offer the right of first refusal on rental properties. 

AGENCY: Island Vacation Properties, LLC is the authorized agent for the owner/landlord. We reserve the right to make reservation changes due to any unforeseen circumstances. Units placed on the market for sale may be shown during your stay with 24 hour prior notice.

SUBSTITUTION OF ACCOMMODATIONS: Where circumstances arise beyond our control (i.e., fire, hurricane, sale of unit, etc.), your confirmed property may be unavailable upon your arrival. Island Vacation Properties reserves the right to substitute your accommodations. We cannot guarantee the confirmed rate in these instances. Although we will do everything possible to create a pleasant vacation experience, neither Island Vacation Properties nor the owner are liable for damages or inconvenience in this rare and unusual situation.

LIABILITY: Tenant agrees to hold Landlord and Island Vacation Properties, LLC harmless from all liabilities and all costs of defense, including attorney’s fees arising out of tenant’s use or possession of the leased property, and all claims, damages and liability incurred to invitees, family or friends of Tenant.

DISPUTES: You are agreeing that if there are any disputes you will contact Island Vacation Properties immediately to attempt to resolve any issues. Your down payment and agreeing to Island Vacation Properties terms and conditions waives your right to request a chargeback or refund, stop payment on any charge made pursuant to this agreement now and in the future, regardless of rental contract signature status.  All complaints or issues must be dealt with directly with Island Vacation Properties. You are agreeing to report any issues during your stay and not after your stay has ended.

RADON GAS: Radon gas is a naturally occurring radioactive gas that, when accumulated in a building in sufficient quantities may present health risks to persons who are exposed to it over time. Levels that exceed Federal and State guidelines have been found in buildings in Florida. Additional information regarding Radon Gas and Radon testing may be obtained from the Manatee County Health Unit. TERMS AND CONDITIONS: Rental terms and conditions are subject to change.

Vacation

Guest Protect Travel Insurance (SUN TRIP PRESERVER – SPF90)

Vacation Rental Insurance provides coverage for the loss of prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. The Sun Trip Preserver vacation rental travel insurance plan includes trip cancellation & trip interruption benefits that may reimburse you for pre-paid, non-refundable deposits as a result of unforeseen covered events. We strongly recommend you purchase this valuable protection.

DAMAGES: Guests are responsible for any intentional damage due to willful negligence, any normal wear and tear will be taken care of by Island Vacation Properties. You must notify us right away of any damage to any and all parts of the property and it’s contents so we can assess and repair this damage quickly. Any damages found after departure will be charged to the credit card on file with a 3% convenience fee. Please be mindful and use care to minimize damage to the property and or any contents in or around the property. Additional terms and conditions apply.
