Vacation Rental Terms and Conditions
Please read these terms and conditions prior to making your reservation.
RENTAL TERMS AND CONDITIONS
KEYS: If you arrive after normal business hours, please pick up your rental keys in the “Welcome” basket by the front door of our office. Keys will be in an envelope with your name on it. Please take care of the keys provided to you — $25.00 lock-out fee applies for any after-hours emergency calls.
CHECK-IN TIME: 4:00 P.M. CHECK-OUT TIME: 10:00 A.M.
Please call the office if you feel you cannot comply with our prescheduled check-in and check-out times. While we will do our utmost to accommodate early arrivals and late check outs, we do need time to clean the rental properties between tenants.
DEPOSITS: A minimum $500.00 deposit paid by Visa or MasterCard is required for all rentals. This initial payment is required to secure your reservation. The amount of deposit will be deducted from the final payment, however, the card number will be held to compensate the landlord for any excessive cleaning charges or damages. Forfeited or retained deposits will not exceed the total cost of rental. No refunds will be made due to inclement weather, no-shows or early departure. Each reservation requires a $30.00 non-refundable reservation fee.
Credit cards accepted for deposits ONLY; we do not accept credit cards for rent.
RENTAL PAYMENTS: Final rental payments are due in full, thirty days prior to occupancy, payable by check to Island Vacation Properties. Keys will not be dispersed until final payment is made.
CANCELLATION: Deposits are non-refundable in the event of a cancellation.
TRAVEL INSURANCE: Travel Insurance is available by CSA Travel Protection for United States, Canadian and UK residents only. It is automatically calculated and added to your contract on the day of reservation. Travel Insurance offers protection against loss of deposits and rent in case of unforeseen illness, accident, jury duty or adverse weather that stops travel. Questions concerning CSA Travel Protection can be answered by calling 866-999-4018, or reviewing the certificate of insurance on their website at www.vacationrentalinsurance.com. Waiving (declining) travel insurance is accepted by forwarding your request in writing to Island Vacation Properties within 10 days of receipt of the rental documents. To protect against the loss of your rental payment and deposit, travel insurance is strongly recommended. Some landlords require a higher deposit if travel insurance is declined.
TAX: Rentals of less than six months are subject to Florida State Sales Tax of 6.5% and Manatee County Resort Tax of 4%.
AGENCY: Island Vacation Properties, LLC is the authorized agent for the owner/landlord. We reserve the right to make reservation changes due to any unforeseen circumstances. Units placed on the market for sale may be shown during your stay with prior notice.
LIABILITY: Tenant agrees to hold Landlord and Island Vacation Properties, LLC harmless from all liabilities and all costs of defense, including attorney’s fees arising out of tenant’s use or possession of the leased property, and all claims, damages and liability incurred by invitees, family or friends of Tenant.
OCCUPANCY: Each unit has a maximum capacity, which you were informed of when making your reservation. Overcrowding of units may result in the immediate eviction and loss of deposit and rent. Large gatherings are not permitted on the premises without prior written approval of the rental agent.
AMENITIES: Each of our rentals is individually owned and reflects the tastes of the owners. We do our best to accurately describe each unit and its amenities prior to booking, but cannot be held responsible if tenants are dissatisfied with the accommodations. If you have any questions about the unit amenities, please call our office. We will gladly discuss them with you. Our rentals do not provide beach chairs or beach towels. Very few rental units provide grills.
SUBSTITUTION OF ACCOMMODATIONS: Where circumstances arise beyond our control (i.e., fire, hurricane, sale of unit, etc.), your confirmed property may be unavailable upon your arrival. Island Vacation Properties reserves the right to substitute your accommodations. We cannot guarantee the confirmed rate in these instances. Although we will do everything possible to create a pleasant vacation experience, neither Island Vacation Properties nor the owner are liable for damages or inconvenience in this rare and unusual situation.
PETS: Units allowing pets require a $150.00 non-refundable pet fee per pet. Any unauthorized pets will result in a penalty equal to your initial deposit and will immediately be charged to your credit card. Unfortunately, we cannot allow any pets over 25 pounds.
SMOKING: Smoking is prohibited in all rental properties. Please smoke outdoors and responsibly discard all smoking debris.
ITEMS LEFT IN UNIT: Neither the landlord nor Island Vacation Properties, LLC, will be held responsible for any personal items left in the units. If you request us to retrieve and mail items left in the unit, you will be responsible for mailing/shipping charges plus $25.00 processing fee.
INOPERABLE EQUIPMENT: Should any mechanical failures occur during your stay, Island Vacation Properties will do their best to make prompt and thorough repairs. Unfortunately, we cannot offer refunds for inconvenience caused by inoperable equipment.
INTERNET SERVICE: Many of our units now offer high speed internet service for your convenience. Due to the numerous different providers and the various ages and configurations of personal computers, we cannot guarantee that you will be able to connect. We will do our best to assist you, but cannot be held responsible and no refunds will be offered if you are unable to take advantage of this service.
SWIMMING POOLS: Pools are heated from approximately Thanksgiving to Easter only and are set no higher than 82 degrees. During cooler weather, we cannot guarantee that the water temperature can be maintained to that degree. We do not offer refunds or discounts for non-operational pools or spas under these conditions.
RADON GAS: Radon gas is a naturally occurring radioactive gas that, when accumulated in a building in sufficient quantities may present health risks to persons who are exposed to it over time. Levels that exceed Federal and State guidelines have been found in buildings in Florida. Additional information regarding Radon Gas and Radon testing may be obtained from Manatee County Health Unit.
The tenant has read and agrees to the rules and regulations described above. Any contract errors should be reported to Island Vacation Properties, LLC immediately. Please sign on reverse side and return one copy to our office to finalize your reservation. Keep the original and any receipts, if applicable, for your files. Failure to return this contract does NOT release the tenant from the rights and obligations stated above.
